Rules
1. General Provisions
1.1. The website is operated by MB Teksera (hereinafter – the Seller). The online store (hereinafter – the Store) operates in accordance with these Terms and Conditions (hereinafter – the Terms).
1.2. Before registering, the Customer must read and agree to the Terms by marking the corresponding checkbox.
1.3. Once registered and having placed an order, the user becomes a Customer of the Store and gains all related rights and obligations.
1.4. The Seller reserves the right to restrict a Customer’s access or cancel registration at any time if the Customer fails to comply with these Terms.
1.5. The Seller reserves the right to modify, update, or supplement the Terms at any time without prior notice. The new Terms become effective from the date they are published on the Store’s website. Orders placed prior to the update remain subject to the Terms valid at the time of ordering.
1.6. The Seller is not liable for any damages incurred by the Customer as a result of failing to comply with these Terms.
2. Personal Data
2.1. The Customer may register on the Seller’s website by providing the required personal information.
2.2. Registration is confirmed automatically, and login details are sent to the email address provided by the Customer.
2.3. By registering, the Customer agrees that the Seller may process their personal data as necessary for the execution of the contract and other legitimate business purposes in accordance with these Terms and applicable EU data protection laws.
2.4. The Seller confirms that the Customer’s personal data is used solely for the identification of the Customer, order processing, and product delivery.
2.5. The Customer undertakes to keep their login credentials confidential and not disclose them to third parties. The Customer bears full responsibility for any breach of this obligation.
2.6. The Seller will not disclose personal data or order information to third parties, except for authorized partners providing delivery or order-related services. Data may also be disclosed to competent authorities in accordance with applicable EU law.
2.7. The Seller ensures the protection of personal data in compliance with the EU General Data Protection Regulation (GDPR) and other applicable legal acts.
3. Purchase Agreement
3.1. Purchases are made through the online store in accordance with EU and national consumer law.
3.2. A purchase agreement is concluded once the Customer places an order and confirms acceptance of these Terms. From that moment, the Customer is obliged to pay the specified price and receive the ordered goods.
3.3. The contract is deemed fulfilled once the Customer has paid for and received the goods.
3.4. The order confirmation sent to the Customer by email constitutes an integral part of the purchase agreement.
3.5. Each order represents a separate sales contract between the Seller and the Customer.
3.6. Consumers have the right to withdraw from a distance contract within 14 calendar days without providing any reason, in accordance with Directive 2011/83/EU. The refund, including the cost of standard delivery, will be made within 14 days of the notice of withdrawal. The Seller may withhold the refund until the goods have been received or proof of return has been provided.
3.7. If a dispute arises, the Customer may seek out-of-court resolution through the competent national consumer protection authority or through the European Online Dispute Resolution (ODR) platform at http://ec.europa.eu/odr/.
4. Payment
4.1. All prices displayed in the Store are final and include applicable Value Added Tax (VAT).
4.2. Payment for goods must be made in advance via secure online payment systems such as PaySera, Stripe, or PayPal.
4.3. Invoices are issued electronically and sent to the Customer’s email address provided during checkout.
4.4. The Seller is not responsible for losses resulting from incorrect payment details provided by the Customer or from third-party banking errors.
5. Delivery
5.1. Free delivery is available for orders exceeding the amount specified on the Store’s delivery information page.
5.2. Delivery fees and estimated delivery times depend on the Customer’s country and are detailed in the Delivery section of the website.
5.3. Orders are processed on working days only.
6. Product Warranty
6.1. The Seller declares that all products comply with normal quality standards applicable to such goods. Product descriptions and main characteristics are available on each product page.
6.2. Product colors displayed online may slightly differ from the actual colors due to variations in screen settings or lighting conditions.
6.3. The Seller is not responsible for damage caused by misuse, improper maintenance, or storage of goods.
6.4. All products sold are covered by a 2-year legal warranty under EU law.
7. Returns
7.1. Return conditions follow EU Directive 2011/83/EU and local consumer protection rules.
7.2. Goods may be returned if they are unused, undamaged, retain their original appearance, and are returned in the original clean packaging with proof of purchase.
7.3. If the returned item is defective, the Seller covers the return shipping costs.
7.4. If the Customer returns a non-defective item, return shipping costs are covered by the Customer. Delivery costs are non-refundable in this case.
7.5. Returned products not meeting return policy conditions will be stored for 14 business days before disposal.
8. Rights, Obligations, and Liability
8.1. The Customer has the right to purchase goods at the prices and conditions set in the Store and to withdraw from the contract within 14 days, provided the goods are not damaged or customized.
8.2. The Customer agrees to comply with these Terms, pay for the ordered goods, and keep account information secure.
8.3. The Seller reserves the right to suspend Store operations, update Terms, modify product prices, or cancel orders if necessary.
8.4. The Seller undertakes to deliver goods in accordance with these Terms, provide accurate product information, and issue a valid invoice after payment.
8.5. The Customer is responsible for the accuracy of submitted information and for safeguarding login credentials.
8.6. The Seller is not liable for indirect losses or damages resulting from failure to read these Terms or for actions of third parties.
9. Other Provisions
9.1. It is strictly prohibited to copy, reproduce, or distribute any content from the Store without written permission.
9.2. These Terms are governed by European Union law.
9.3. Any disputes will first be resolved through negotiation. If an agreement cannot be reached, disputes shall be referred to the competent court or to the EU Online Dispute Resolution (ODR) platform at http://ec.europa.eu/odr/.
9.4. Prices listed on the website apply exclusively to online purchases.
9.5. Invoice corrections must be requested within 24 hours of placing an order.
9.6. Invoices are sent to the Customer’s email address specified in the order.
